1. The Defendant’s KRW 123,91,265 to the Plaintiff and 5% per annum from July 28, 2015 to July 21, 2016 to the Plaintiff.
Reasons
1. Basic facts
A. The plaintiff is a corporation with the purpose of electrical construction, etc., and the defendant is a corporation with the purpose of electricity, information and communications construction, software development and manufacture.
B. Since around 2008, C and D, the representative director of the Plaintiff, were trading in the form of sub-subcontracting the contracted construction work to the Plaintiff by the Defendant and D Co., Ltd. (hereinafter “E”), which is the Defendant’s representative director, to the Plaintiff.
C As to the transactions between the Plaintiff, D, Defendant, and E, the Customer Director (the Customer Director of this case hereinafter referred to as the “Transaction Director”) of the content as shown in the attached Table No. 2 has been prepared.
C. The Defendant was awarded a contract for G’s electrical construction in Busandong-gu with the Korea Transportation Safety Authority, and around May 2012, ordered the Plaintiff to pay KRW 26,216,800 to the Plaintiff, and the Plaintiff completed the construction work thereafter. 2) The Defendant was awarded a contract with the Busan Eastdong-gu Office of Education for the toilet improvement and electrical construction of H elementary school located in Busan Dong-dong-gu, and ordered the Plaintiff to pay KRW 7,645,400 to the Plaintiff on July 2012, and the Plaintiff completed the construction work thereafter.
3) On June 2014, the Defendant contracted the “I Corporation” from the Naval Operations Headquarters, and ordered the Plaintiff to pay KRW 63,117,120 (including value-added tax), and the Plaintiff completed the construction work thereafter. 4) The Defendant was awarded a contract from Kudo Communications Co., Ltd. (hereinafter “ Kudo Communications”) for the installation of CCTV, etc. for security surveillance at the Busan Jindo level (hereinafter “J”) for KRW 500,000,00, and ordered the Plaintiff to pay KRW 460,000 to the Plaintiff around March 2013.
5) On the other hand, E is a L Communications Corporation (hereinafter “L Corporation”) newly built by the Office of Education of Gyeongnam-do to K in close time.
B. A contract, around December 2013, subcontracted to the Plaintiff KRW 119,073,00.
The plaintiff shall pay the money to the defendant 10,000.
