A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, while promoting the construction of new buildings for the purpose of leasing business against USFK on the land owned by Pyeongtaek-si B and his father, Gyeonggi-si D, which is his father, was in mind to appropriate farmland diversion charges to be paid to the Korea Rural Community Corporation for the implementation of the business, from the F Co., Ltd. (hereinafter “victim Co., Ltd”).

On July 16, 2019, the Defendant: (a) entered into a contract with the victim company and its construction cost, 179, 220,000 won (hereinafter “the instant contract”); (b) entered into a contract with the victim company and its construction cost, 4,550,00 won (hereinafter “the instant project”); and (c) return the farmland diversion charges to the Korea Agricultural and Fishing Corporation (hereinafter “the instant contract”); and (d) deposit the farmland diversion charges into the farmland diversion charges with the victim company and its construction cost, 3,50,00 won (hereinafter “the instant contract”).

After that day, the victim company transferred KRW 4,355,00 to the virtual account in the name of H bank under the name of the Korea Rural Community Corporation, as farmland charges of the defendant.

However, at the time, the Defendant had already borne the liability of KRW 861,00,000 from the I Association and the J Association of KRW 154,20,00,000. In addition, the Defendant had already been able to obtain additional loans on the land of Gyeonggi-si B, the maximum amount of KRW 12,19,300,000,000, and the amount of KRW 2,080,000,000,000, in the land of Gyeonggi-si D, respectively. In addition, the Defendant was able to obtain KRW 20,000,000 or KRW 30,000,000 per annum.
