The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. In light of the facts stated in the judgment of the court below, the defendant of mistake of facts shows his attitude in the same direction as the victim, and it is not good that the victim seems to have been aware of his awareness of the defendant without any reason. Thus, even though the defendant did not have any act or intent to commit indecent act by compulsion, it is erroneous in the misapprehension of facts that the court below found the defendant guilty of the facts charged of this case and affected the conclusion of the judgment.

B. The sentence imposed by the lower court on the grounds of unfair sentencing (eight months of imprisonment, two years of suspended sentence, etc.) is too unreasonable.

2. Determination

A. 1) The lower court also asserted the same purport as the grounds for appeal in this part. In full view of the circumstances in its reasoning acknowledged by the evidence duly admitted and investigated by the lower court under the title of “determination on the Defendant and his defense counsel’s assertion,” the lower court determined that the Defendant’s act itself constitutes indecent act and constitutes indecent act, and that the Defendant was guilty of the facts charged in this case. 2) The lower court’s determination based on the precedents, evidence rules, and evidence on the criteria for determining the credibility of the statement by the person claiming sexual assault victims is justifiable, and it does not err by misapprehending the facts, thereby affecting the conclusion of the judgment.

Therefore, we cannot accept this part of the defendant's assertion.

B. The exercise of the tangible power revealed through the facts charged on the assertion of unfair sentencing is considerably weak, and the degree of indecent act is not serious, and the defendant voluntarily attends the police station by reporting a hand-off log containing his own CCTV-cap photograph, and there is no record of criminal punishment.
