A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who is engaged in driving of B Poter cargo vehicles.

On May 18, 2019, at around 23:57, the Defendant driven the above cargo while under the influence of alcohol 0.109%, and led the Defendant to drive the said cargo in the direction of F from the direction of E to the road front of the “D cafeteria” located in the Jeonnamdo C.

At the time, it was an intersection in which no signal apparatus was installed at night, and in such a case, there was a duty of care to prevent accidents in advance, such as reducing speed to those engaged in driving of a motor vehicle, maintaining the right and the left well, operating the steering and steering system accurately, failing to drive a motor vehicle while under the influence of alcohol, etc.

Nevertheless, the Defendant neglected to do so and did not properly look at the left and right while under the influence of alcohol and was negligent in entering the intersection, which was driven by the victim G(20 years of age) who was driving in the right direction of the Defendant, and received the part prior to the driver's seat of the above cargo vehicle driving by the Defendant.

Ultimately, the Defendant by such occupational negligence inflicted injury on the victim G, such as knee, tension, etc. in light of the following conditions: (a) the victim I (the 20-year old-age-old-car), who was on the said knee, knee, knee, and other parts requiring treatment for about two weeks; (b) the victim J (the 20-year-year-old-old-old-car); (c) the victim K (the 20-year-old-old-year-old-old-car knee, tension, etc.; and (d) the victim K (the 20-year-old-old-year-old-old-car kne, knee, etc., requiring treatment for about two weeks; and (e) the victim L (the 19-year-old-year-old-car kne, etc.
