The appeal is dismissed.

The grounds of appeal are examined.

1. As to the Defendant’s case, the Defendant and the Defendant’s custody applicant (hereinafter “Defendant”) did not state their grounds of appeal on the grounds of appeal, and the petition of appeal does not state the grounds of appeal.

2. On the grounds indicated in its reasoning, the lower court rejected the allegation on the grounds of appeal disputing the first instance judgment recognizing the need for the treatment and custody of the Defendant and the risk of recidivism.

Examining the grounds for appeal in light of the evidence duly admitted, there is no error of law regarding the judgment on the treatment and custody for reasons such as exceeding the bounds of the principle of free evaluation of evidence even if the circumstances alleged in the grounds for appeal are considered

3. Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
