피고인은 2014. 4. 29.경 고양시 일산동구 B, 606동 303호에 있는 피고인의 집에서, 인터넷 C 게시판에 성명불상자가 ‘D 민간잠수부라고 한적 없다 주장’이라는 제목으로 관련 신문고 기사 url을 링크한 게시물에 세월호 침몰사고 관련 방송 인터뷰를 한 피해자 D에 대하여 닉네임 ‘E', 아이디 ’F'를 사용하여 ‘요년 하는 짓이 귀엽네 ㅁㅊ년‘이라는 댓글을 게시하여 공연히 피해자를 모욕하였다.
