1. The plaintiffs' claims against the defendants are all dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The relationship between the parties (1) The Network J (hereinafter “the deceased”) was established and operated by Defendant H around March 14, 2002, and died on August 13, 2012. Accordingly, Plaintiff A and his children, who were the wife of the deceased, jointly succeeded to the deceased’s property.
(2) At the time of the deceased’s death, the deceased (6,800 shares), the Plaintiff A (3,000 shares), Defendant G (4,200 shares), and E (6,00 shares) were registered as the shareholders of Defendant H.
(3) Defendant I was established on June 21, 2010, and Defendant I listed Defendant D (4,500), K (3,000 shares), and L (2,50 shares) as Defendant I’s shareholders on the list of shareholders.
B. (1) On September 10, 2012, the Plaintiffs, as Defendant D, assigned 11,00 shares (including 4,200 shares trusted by the deceased to Defendant G) inherited from the deceased and 3,00 shares of Plaintiff A, total of 14,00 shares (hereinafter “instant shares”) to Defendant F in total, KRW 350,00 shares (hereinafter “instant shares”).
(2) On August 17, 2012 and August 22, 2012, Defendant D, who was in charge of Defendant H’s tax declaration, settlement of accounts, etc. at the time of the deceased’s death, presented to the Plaintiffs a summary of the financial status as indicated below, prior to the conclusion of the instant transfer contract with Defendant F, on two occasions, and explained to the Plaintiffs regarding the value of assets of Defendant H.
