Reasons
Punishment of the crime
[2013 Highest 3284]
1. On October 26, 2013, the Defendant violated the Punishment of Minor Offenses Act: (a) around 22:29 on October 26, 2013, the Defendant used his/her mobile phone (D) from the “C Kinginginging Ka-gu, Seocheon-gu, Seocheon-gu, Seocheon-si, and reported that he/she was killed by a public official in charge of receiving 112 reports on two occasions; and (b) the Defendant sent five police officers who received the said 112 reports to the said King Ka-si.
Accordingly, the Defendant reported a false crime to a public official.
2. On November 5, 2013, the Defendant: (a) around 02:30 on November 5, 2013, at “G main stores” operated by the Victim F in Seocheon-gu, Seocheon-si E; and (b) even if having received alcoholic beverages, etc. from the victim, the Defendant issued an order of alcoholic beverages, etc. as if the victim would normally settle the price; and (c) the Defendant acquired pecuniary profits equivalent to the amount of the said amount by being provided with alcoholic beverages, etc. equivalent to KRW 20,00 at the
[2] On August 26, 2013, around 02:55, the Defendant stated the victim I’s I’s written indictment in Seocheon-gu, Seocheon-gu, Seocheon-si as “victim K,” but in light of the record, it is obvious that this is a clerical error, and thus, it should be corrected and stated as above.
The Court ordered alcoholic beverages, etc. as if the victim would normally settle the price, and then acquired financial profits equivalent to the amount of 58,000 won by receiving alcoholic beverages, etc. from the victim.
