1. The Defendant (Counterclaim Plaintiff) is jointly and severally liable to the Plaintiff (Counterclaim Defendant) for KRW 39,615,181 and its amount from October 16, 2015.

1. Facts of recognition;

A. The Plaintiff is the owner of the real estate indicated in the attached Form (hereinafter “instant building”).

B. The Defendants are those engaged in stone construction business, etc. under the trade name of “F” in Seo-gu, Seo-gu, Incheon. Defendant B is the business owner of “F,” Defendant C is the business owner of “F,” and Defendant C is the husband of Defendant B who actually operates “F.”

C. Around June 2, 2015, the Plaintiff presented to Defendant C a color plan drawings of the building that is part of the newly constructed design drawings of the instant building (hereinafter “instant drawings”) and sought advice on the construction cost, such as building stones attachment.

Accordingly, according to the instant drawing, Defendant C explained to the Plaintiff that “high-water constructed in the Jeju color part is KRW 80,000 per square meter, KRW 70,00 per square meter per square meter, KRW 72,00 per square meter per square meter, and KRW 52,00 per square meter per square meter, and KRW 52,00 per square meter for interior stairs,” written that “high-water 80,000, classical 70,000, internal damp-proof 52,000,” and signed and sealed the said drawing.

E. On June 2, 2015, the Plaintiff entered into a construction contract for stone, stairs, and hot-water construction of the instant building (hereinafter “instant construction contract”) with the Defendants as follows. As to the foregoing building, the Plaintiff agreed to perform construction works for the stone, stairs, and hot-water construction of the instant building with the color or price similar to the high-defluence, as described in the drawing of the instant building (the second, third, third floor) with respect to the foregoing building, with a view to construction of 90,000 won, and with a unit price raised to 90,000 won. The remainder of the emphasizing part (the first, second, and third floor) and auxiliary color (the part) agreed to be built with the Han River as the first-mancheon and Pocheon-do.

1. Construction name: Construction of new G neighborhood living facilities and multi-family houses, stone, stairs, and hot stones;

2. Construction place: Seo-gu Incheon Metropolitan City.

3. Period: From June 8, 205 to June 30, 2015 (21 days);

4. Construction cost: settlement black 20T 20T -90,000 won, 30T - 70,000 won, 40T - 1.50,00 won after the survey.
