가. 협박 피고인은 2015. 3. 5. 14:00~15:00경 성남시 중원구 C에 있는 피해자 D(여, 43세) 운영의 ‘E식당’에서 술을 마시던 중 아무런 이유 없이 그곳에 있는 LPG가스 난로를 들어 ’다 죽여버린다‘고 소리치는 한편 ’가게 정문, 후문에 석유 한말 뿌리면 너희는 그 안에서 꼼짝없이 한방에 다 죽는다‘고 말하여 피해자를 협박하였다.

나. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등협박) 피고인은 2015. 3. 7. 16:30경 위 식당에서 술을 마시던 중 아무런 이유 없이 그곳 종업원인 피해자 F(여, 47세)에게 ‘씨발년 썅년들, 다 죽여버린다. 나는 한다면 한다’는 등 욕설을 하여, 피해자가 ‘술 마시고 그냥 자러 들어가라’고 하자, 상의 왼쪽 안주머니에 있는 위험한 물건인 과도(총길이 약 20cm, 칼날길이 약 10cm)를 보여주면서 ‘주인 년부터 먼저 죽이고 니네들 차례차례 다 죽여버린다. 한 년만 죽이면 니네는 차례차례 죽는거다’라고 소리쳤다.
