전기통신 금융 사기( 속칭 ‘ 보이스 피 싱’) 범죄조직의 총책인 성명 불상자는 전기통신 금융 사기 범죄를 위하여 유인책, 관리 책, 현금 수금 책 등 여러 단계를 조직하고, 유인책에 속하는 조직원들은 무작위로 피해자에게 전화를 걸어 피해자의 자녀를 데리고 있다며 돈을 가져오지 않으면 자녀에게 위해를 가하겠다는 등의 거짓말을 하여 피해자들 로 하여금 현금을 인출하여 가지고 오도록 유인하고, 관리 책에 속하는 조직원들은 현금 수금 책을 모집하고 현금 수금 책에게 피해 자로부터 돈을 받을 장소를 알려주고, 피고 인은 위와 같은 범행에서 성명 불 상의 보이스 피 싱 조직원으로부터 중국 모바일 메신저인 위챗을 통해 “ 절대로 함께 다니지 말고, 장소를 알려주면 돈을 받아 오며, 움직일 때에는 항상 마스크를 착용하라.” 라는 등의 주의사항과 여비 등을 전달 받고 향후 보이스 피 싱 범행의 대가를 받기로 약정하고 현금 수금 책의 일원으로 피해자를 직접 만 나 현금을 건네받아 다른 조직원에게 전달하는 역할을 하기로 하였다.
