1. The plaintiff's appeal is dismissed.

The purport of the claim and appeal is the purport of the appeal.

1. The grounds for appeal by the plaintiff citing the judgment of the court of first instance are not significantly different from the allegations in the court of first instance, and even if the evidence submitted in the court of first instance is added to the evidence submitted in this court, the fact-finding and judgment of the court of first instance

Therefore, the reasoning of the judgment of this court is as follows, except where the defendant added the judgment under Paragraph 2 as to the assertion that the defendant emphasizes or adds to this court, and thus, it is identical to the reasoning of the judgment of the first instance.

2. The addition;

A. The Plaintiff asserts to the effect that the instant accident occurred without installing a vehicle bank fence at the place where the instant accident occurred, notwithstanding the fact that it is necessary to install a vehicle bank fence on the side of the road to prevent the leaving of the road because the instant road is a road connected to the roadway for the purpose of protecting the road and using it in an emergency, and it constitutes a "road shoulder", and since the road is a dangerous section or an accident is highly likely to occur frequently, it is necessary to install a vehicle bank fence on the side of the road.

(b) The provisions of the Road Act, regulations on the standards for structure and facilities of roads, and regulations on the installation and management of road safety facilities shall be as follows:

The definitions of terms used in this Act and Article 2 of the Road Act shall be as follows:

1. The term "road" means any road, enumerated in Article 10, comprised of facilities prescribed by Presidential Decree, such as roadways, sidewalks, bicycle lanes, side roads, tunnels, bridges, overpassess, etc. and includes road appurtenances;

2. The term "road appurtenances" means any of the following facilities or structures installed by a road management agency for convenient use, safety, and smooth road traffic, and management of a road:
