피고인은 2012. 8. 9.경 서울 강북구 B고시원에서 피해자 C의 카카오스토리에 피해자가 작성한 글인 ‘꽃처럼 아름답게’에 댓글로 “크ㅎㅎㅎ~뭐하냐! 어디까지봐냐~간첩주제에~ㅎ”라고 게재하여 비방할 목적으로 정보통신망을 이용하여 공공연하게 거짓의 사실을 드러내어 피해자의 명예를 훼손하였다.
