Reasons
Punishment of the crime
1. Defendant A around November 21, 2002, with the permission to install livestock excreta discharge facilities on four parcels, including Da, Chungcheongnam-gun, Chungcheongnam-gun, etc., and raising milch cows and box with the trade name of “E farm” in which excreta discharge facilities such as livestock pens are installed.
(1) A person who installs livestock excreta-generating facilities without permission shall not discharge livestock excreta without discharging it into a disposal facility in disposing of livestock excreta discharged from a waste-generating facility. Nevertheless, on September 2009, the Defendant did not discharge livestock excreta without discharging it into a disposal facility without discharging it. Nevertheless, in disposing of livestock excreta without permission, the Defendant discharged 12,000 g of livestock excreta (4 km 1,000 x 30 g of daily average discharge quantity of livestock excreta discharged from milch cows (4 cm X 100 mx 1,000 mx 30 days) without discharging it into a compost, etc., which is an excreta treatment facility, from around April 2013, without discharging it into a disposal facility without permission, as stated in the attached Table of Crimes (1).
Nevertheless, around September 2009, the Defendant, while raising 20 mar 20 mar in Yaeaea-gun, Ya-gun, Chungcheongnam-gun, Ya-gun, and discharged excreta 105,600 mar (5 mar 4kg X 20 mar x30 mar per day of 1mae-1st, average discharge quantity of excreta 1mn) from Korea to compost, etc., which is an excreta treatment facility, and discharged excreta 105,00 mar in total from that time to April 2013, as shown in the list of offenses (2).
3. A person who installs a livestock excreta discharge facility, such as manure effective manure, around February 3, 2011 shall not use manure or liquid manure in an unregistered state or give it to other persons when disposing of livestock excreta in accordance with a resource recovery plant.
