피고인은 2012. 5. 18. 22:40경부터 23:35경까지 서울 중랑구 B에 있는 피고인의 집에서 C, D, E, F가 화투 20매를 이용하여 각 5장씩 나누어 갖은 후 끝수가 높은 사람이 승리하는 방식으로 수십 회에 걸쳐 판돈 768,000원으로 속칭 ‘도리짓고땡’이라는 도박을 한다는 사실을 알면서도 이를 돕기 위하여 그 장소와 화투 등을 제공함으로써 그들의 도박행위를 용이하게 하여 방조하였다.
