A defendant shall be punished by imprisonment for four months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On November 7, 2006, the criminal defendant against the victim C told the victim C to pay the interest of KRW 1.5 if he/she lends his/her clothes to the victim C in light of the "F clothes" operated by the defendant in the E market 2-Gu 108 of Jinju-si, E market 2-Gu 108.
However, the defendant did not have any intention or ability to repay even if he borrowed 5 million won from the injured party, because he used bonds at the time when he borrowed 70 to 10 million won a month.
Nevertheless, the Defendant, as seen above, obtained a total of KRW 36,30,000 from the time to June 30, 2008, including by deceiving the victim and receiving KRW 5,000,000 from the victim, to June 30, 208, through the issuance of KRW 36,30,000,00 from the time of the crime Nos. 1 through 7.

On April 3, 2008, the Defendant against Defendant G stated that, in light of the “F clothes” as above, H lent money to the victim G via “F clothes,” and that, if the Defendant loaned money to the victim G as security, the interest shall be paid in four copies per month and the principal shall be paid in full until June 10, 2008.”
However, the Defendant used the bonds at the time and paid the monthly amount of KRW 2,00,000 for the number of days. Since the Defendant used part of the borrowed money from the damaged person as a bond interest, etc., he did not have any intent or ability to repay the borrowed money from the damaged person, even if he borrowed money from the damaged person.
Nevertheless, the Defendant, as seen above, by deceiving the victim and receiving KRW 5.2 million from the victim to June 3, 2008 on the same day, obtained the delivery of KRW 7.8 million through two times, such as the [Attachment Table 8] No. 8 and the [Attachment Table 9] from June 3, 2008.
3. The Defendant against the victim H was on May 17, 2008.
