Punishment of the crime

피고인은 2017. 3. 초순 일자 불상 경 대전 서구 B 아파트 C 호에 있는 피고인의 주거지에서 인터넷을 통하여 어린이 도서 전집을 대여하는 영업을 하는 회사인 피해자 ㈜D 가 운영하는 홈페이지 E에 피고 인의 아이디 (ID) ‘F’ 로 접속하여 ‘ 수 담뿍 수학 동화’ 도서 전집을 대여기간이 만료되면 반환을 하겠다는 취지로 대여신청을 하고 최초 대여료 34,900원을 피해 자가 제공한 가상계좌로 입금을 하였다.

그러나 사실 당시 피고인은 채무 누적에 따른 신용 불량 상태로서 생활비 압박에 시달리고 있는 상황으로 피해 자로부터 ‘ 수 담뿍 수학 동화’ 도서 전집을 제공받더라도 도서의 내용을 보기 위하여 대여 받는 것이 아니고 이를 임의로 타인에게 처분하여 생활비 등을 조달할 계획이었으므로 도서를 반환할 생각은 없었다.

피고인은 이와 같이 피해자를 기망하여 이에 속은 피해 자로부터 2017. 3. 10. 370,000원 상당의 ‘ 수 담뿍 수학 동화’ 어린이 전집 도서를 위 주거지로 배송 받은 것을 비롯하여 별지 기재 각 접속 아이디 별 ‘ 대여 내역’ 과 같이 모두 74회에 걸쳐 합계 금 33,273,300원 상당의 도서를 배송 받아 피해자의 재물을 편취하였다.
