【Criminal Facts】

The defendant is a person who is engaged in driving the BM6 car.

1. On June 28, 2018, the Defendant violated the Road Traffic Act (unclaimed Measures after Accidents) (hereinafter “Road Traffic Act”), without obtaining a driver’s license of a motor vehicle on or around 17:50 on June 28, 2018, the Defendant continued to run approximately 174 m/h of the original road of the Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, and about 30 m/h of the speed from the front of the three-distance intersections.

Since there are many places where the traffic of vehicles is frequent due to the intersection section, there was a duty of care to prevent accidents in advance by safely driving the vehicle, such as reducing speed to the person engaged in the driving of the vehicle, accurately manipulating the steering system, brakes, etc., by safely driving the vehicle.

Nevertheless, the Defendant neglected this and went into the intersection due to the negligence of the Defendant, who was driving by the victim C (the age of 58) who was driving the D SM6 car driving with the front wheels of the driver's seat in the D SM6 car driving.

Ultimately, the Defendant, by occupational negligence as above, destroyed the car in the Swiss area owned by the victim to be repaired in KRW 1,198,148, and immediately stopped and escaped without taking relief measures, etc.

2. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) and the Road Traffic Act and the Defendant, at the above date, at the above location and place, were driving the said SM6 car with the first line in front of the CM6-distance intersection road in Chungcheongnam-si, Chungcheongnam-si, Chungcheongnam-si, Seoul Special Metropolitan City, and the first line in front of the CM6-distance intersection, and continued to drive the said SM6 car as stated in paragraph (1).

In such cases, the driver is engaged in driving of motor vehicles.
