1. The Defendant shall pay to the Plaintiff KRW 12,580,908 as well as 25% per annum from May 28, 2016 to the day of full payment.
Reasons
1. Basic facts
A. On September 1, 2014, the Plaintiff and the Defendant lent KRW 50,00,00 to the Defendant at the interest rate of KRW 2.5% per month, and the due date of repayment of KRW 2.5% on December 30, 2014, and the Defendant’s mother’s joint and several surety, and ② on September 16, 2014, the Plaintiff set the Defendant at the interest rate of KRW 50,00,000 to the Defendant 2.5% per month, and the due date of repayment of KRW 31 December 31, 2014, respectively, and C written a loan certificate with the content that the said obligation is jointly and severally guaranteed.
(hereinafter referred to as “the instant loan” in total, and each of the above loans was referred to as “the instant loan”). B.
Accordingly, the Plaintiff transferred KRW 8,1750,000,00 to the account under the name of D (hereinafter “D”), ① on September 1, 2014, ② on September 2, 2014, ② on September 10, 2014, ③ on September 16, 2014, ③ KRW 20,6150,00, ④ on September 22, 2014, ④ on September 22, 2014, ⑤ KRW 5,600,00,000,000, including KRW 8,1750,000,000,000.
C. C paid KRW 8,00,000,000 to the Plaintiff for the repayment of the instant loan claims, respectively, and KRW 20,000,00 on July 16, 2015, and KRW 3,00 on May 27, 2016.
C On October 20, 2015, the Plaintiff completed the registration of ownership transfer for the purpose of payment in kind by determining the sales value of the instant forest E-gu, 2928 square meters (hereinafter “instant forest”) as KRW 310,000,000 in the Cheongju-si, Cheongju-si, Cheongju-si, as owned by D, and the Plaintiff agreed to take over the obligation to lend the instant forest as security (principal principal KRW 252,100,000). In fact, the amount of the Plaintiff’s subrogation is indicated below.
