A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On December 30, 2011, the fraud Defendant issued, to the victim E office operated by the victim D in Gwanak-gu, Seoul Special Metropolitan City, the mining register to the effect that the Defendant forged against the victim at the office of the said Co., Ltd. on the following grounds: (a) “The Defendant has the right to extract from his own mine; (b) transferred the right to extract from his mine to his original deposit; and (c) changed the profits in an amount equivalent to KRW 150 million if he proceeds from the future business; and (d) issued, respectively, the mining register to the effect that the Defendant had the right to extract from the “FF G, H, I,” and “JJ unit before his own in the Gyeongjin-gun, Chungcheongnam-gun, Seoul Special Metropolitan City.”

However, the above contents did not have extracting rights for the mine, and the mining register issued to the victim was forged.

As such, the Defendant, by deceiving the victim and deceiving the victim on December 30, 201, obtained KRW 10 million as the down payment from the victim on or around December 30, 201, KRW 10 million as the same name on or around January 20, 2012, and KRW 5 million as the same name on or around March 23, 2012, and acquired KRW 25 million in total from the victim to the account bank in the name of K.

2. Forgery of public documents and the uttering of forged public documents;

A. From November 29, 2011 to December 29, 2011, the Defendant: (a) in a PC room near the calendar station in Gangnam-gu Seoul, Seoul, in which the trade name is unknown; (b) contained the mining register in the Ful unit G, H, and I of the G, H, and I of the Fullle-gun, Chungcheongnam-do; and (c) contained this in the screen board program as “the extraction rights”, the term column for the extraction rights was 20 years from “1999/03/24 to 2019/03/23 of the registration date”; (d) deleted and stored each “199-03-23” in the registration date; and (e) made the following registration number column with the Korean number No. 2011/02/24 through 2031/203/2031/203; and (e) made the following registration number No. 231-131/20-1 of the parts “the two-day’s.”
