Punishment of the crime

Defendant

A is a person who operated a building C in Asan City and a "D Game Site" on the second floor, and Defendant B is a person in charge of exchange against customers in the above game site.

No one shall exchange, arrange for exchange, or repurchase tangible or intangible results obtained through the use of game products as a business, and no game products related business entity shall allow others to do gambling or perform other speculative acts by using game products, or leave them to do so.

Nevertheless, on April 2019, Defendant A requested Defendant B to the effect that “if customers request to exchange the game room, they will do so.” Defendant B would engage in the business of exchanging the outcome of the game by receiving Defendant A’s request and allowing customers to engage in gambling and other speculative acts using the game.”

According to the above public offering, from May 2, 2019 to May 15, 2019, Defendant A administered the operation of the game room, such as setting up 30 games, 50 games, and 100 games, such as 20 games, and 100 games, and supervising employees in the above game room, and ordered Defendant B to exchange the results obtained through the use of the above game. Defendant B, upon the instruction of Defendant A, exchanged the points in cash by calculating the amount of KRW 1 per point if the points obtained by customers exceed 20,000.

As a result, the Defendants conspired to exchange tangible and intangible results obtained through the use of game products for business purposes, and had them do gambling and other speculative acts using game products.
