Reasons
Punishment of the crime
On August 27, 2015, Defendant A was sentenced to imprisonment for one year and four months, three years of suspended execution, six months of imprisonment for Defendant D, and two years of suspended execution, respectively, and the judgment on September 4, 2015 became final and conclusive on August 4, 2015.

C On December 26, 2013, the same court was sentenced to four months of imprisonment and two years of suspension of execution for a violation of the Food Sanitation Act, and the above judgment was finalized on January 3, 2014. On December 22, 2015, the same court was sentenced to a fine of seven million won for a violation of the Food Sanitation Act, and the above judgment was finalized on December 30, 2015.
【Criminal Facts】
1. Violation of the Food Sanitation Act and the Pharmaceutical Affairs Act;
A. On August 27, 2015, Defendant A: (a) leased a prefabricated building installed in Y in Chungcheongnam-gun, Chungcheongnam-gun; and (b) registered as a business operator from around April 2014 to registered as “L”; and (c) took overall charge of selling green X-ray, a melt-ray containing melt and herb materials, by false or exaggerated advertisement against tourists; (b) on August 27, 2015, the Daejeon District Court: (c) provided that: (d) imprisonment with labor for a violation of the Food Sanitation Act; (d) three years of suspended sentence; (d) borrowed the name of M, N, and Defendant B; and (d) opened instructors (a person in charge of advertising products for senior citizens at his/her office); (d) intended to recruit and sell products by soliciting senior tourists using melt-ray to recruit them free of charge or by soliciting them to buy free of charge; and (e) engaged in soliciting and selling free of charge tourism tickets.
