Reasons
1. Summary of the facts charged in the instant case “2015 Godan82”
1. The defendant, as the head of the residents' self-governing council of Co., Ltd. (A) Co., Ltd. (C) (hereinafter “C”), had been entrusted with the authority to sell the apartment and all related loans when residing in C.
C At the same time, from among the buyers of the above apartment, a transfer registration of ownership has been made to those who have not paid the sale price, and at the same time a special sale was made so that they may receive a loan from the bank as security and pay a part of the sale price by obtaining a loan from the bank. F (No. 106 Dong 402) and G (No. 107 and 407) have received a special sale (No. 105 Dong 107 and Nov. 10, 201).
On the other hand, the defendant has a right to C as much as the unpaid portion out of the security value of the apartment unit sold in lots by F and G, and explained that C's existing creditors (H, I, and J) should complete the sale process by providing it as security and arranging the debt relationship so that compulsory execution such as provisional disposition could not be possible, and then, he received a certificate of personal seal impression and seal from F and G, respectively.
On the other hand, when the amount of money to pay the construction cost to the construction business operator who carried out the remodeling project for the above apartment was insufficient, the Defendant, using the F, G’s certificate of personal seal impression and seal received in advance, set up a collateral security on the apartment unit sold by F and G, offered it as security, and received a new loan from K, with the amount of KRW 150 million in the name of C from K.

For the foregoing purpose, the Defendant forged private documents for the foregoing purpose at the E Apartment Management Office around December 28, 2010, the Defendant delegated the registration of the establishment of a mortgage with the content of KRW 200 million with the maximum debt amount in the above apartment 106, KRW 402, and KRW 107,000,000, and KRW 105,000,000,000,000,000,000,000,000,000,000,000.
