A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

Even if the defendant receives money from each of the following victims, he/she did not have an intention or ability to deliver books or other articles:

On May 19, 2013, the Defendant made a false statement that “When sending 300,000 won, the Defendant will deliver the said book” to the victim F, who reported and contacted at his own house located in Changwon-si, 202 Dong 907, Changwon-si, 2013, a member C building 202 Dong 907.

The Defendant, as stated in the separate crime list from May 13, 2013 to June 24, 2013, received KRW 300,000 from the victim’s own foreign exchange bank account (G) and acquired a total of 7830,000 won from the victim 39 times in total by the above method as stated in the separate crime list.

1. At around 17:00 on November 29, 2013, the Defendant, at his own house located in Changwon-si Member C, 202 Dong 907, Dong 202, Dong 907, the Defendant sent a false statement to the victim, stating that “When sending KRW 80,000,000, the Defendant will deliver the said book.”

The Defendant received 80,000 won from the victim’s own national bank (I) account on the same day, and, from around that time to December 13, 2013, acquired 1,50,000 won in total from 10 members of the victim through the above method as stated in the crime list as shown in the attached Table from around December 13, 2013.

2. On December 1, 2013, at the same place as Paragraph 1, the Defendant made a false statement to the effect that “I wish to purchase bond theory and real right law” posted by the Victim K by accessing the Internet JJ, and “I will deliver the above book if you send 50,000 won.”

The defendant received 50,000 won from the victim to his own national bank account on the same day and acquired it by fraud.
