[2013 High 354] The Defendant is the captain of C (9.7 metric tons, FRP, and six crew members on board) who is the ship owner's coastal network fishing vessel in Incheon Cheongjin-gun, Incheon. The Defendant is the person responsible for the operation and operation of the vessel.

On October 16, 2012, at around 07:00, the Defendant carried an anchor connected to a fishing network from the 4-day sea (N 37°32°22, N 125°43°16, N 125°46, N 200) toward the fishing vessel using the route.

In such cases, when the defendant, as a captain responsible for the operation and safety of fishing vessels, carries out dangerous work, such as fishing gear, etc., he/she has the duty of care required to take into account the maritime weather such as the steering and wave, to check in advance the paralysis of the lines connected to anchor and replace a severe marina, to thoroughly conduct safety education on the methods of operation, etc., and to prevent the injury of seafarers, etc. that may occur in advance.

그럼에도 불구하고 피고인은 조류가 강하게 흘러 동 어선이 심하게 흔들리는 상태에서 무리하게 닻을 올리는 작업을 지시하면서 사전 안전교육을 실시하지 않았고, 약 10년간 사용한 로프의 마모정도를 철저히 확인하지 않은 채 평소처럼 아무 일없이 선원들이 알아서 잘 하겠지 라는 안일한 생각으로 로프에 걸린 강한 장력을 완화하는 등의 조치를 다하지 않은 과실로 닻과 연결되어 있던 와이어로프(직경 약26mm)가 강한 조류의 힘을 받아 로프의 낡은 부분이 절단됨과 동시에 연결되어 있던 다른 로프(일명 : 배잽이, 직경 약34mm)가 튕기면서 선수 좌현에 작업을 하던 선원 D(48세)의 가슴과 왼쪽 팔을 가격하여 중심을 잃고 선수에 열려 있던 어획물 창고 안으로 추락하여 좌측 제5, 6, 7번 늑골 골절 등 약 5주 이상의 치료를 요하는 상해를 입게 하였다.
