Reasons
Punishment of the crime
1. Defendant A
A. On April 8, 2013, at around 20:28, the Defendant driving a fenz car without obtaining a driver’s license in approximately 200 meters from the front side of the D Building in Seongbuk-gu, Sungnam-si to the underground parking lot of the building E.
B. On April 8, 2013, at around 23:17, the Defendant violated the Road Traffic Act (e.g., refusal to take a noise level), the Defendant was required to take a drinking test by inserting the alcohol level at around 20 minutes in a so-called alcohol measuring instrument from the staff of the settlement office and the guard of the branch police station, who was called for 112 after receiving 112 a report, while driving a Fenz car at the underground parking lot of the building E-gu in Seongbuk-gu, Seongbuk-si, Seongbuk-si, Sungnam-si, by taking the alcohol level on April 23:39, 2013, on the ground that there are reasonable grounds to suspect that the reporting person and his/her neighbors were driving under the influence of alcohol, such as the Defendant’s statement that he/she was driving.
Nevertheless, the Defendant did not put the whole in a drinking measuring instrument and did not comply with a police officer's request for a drinking test without justifiable grounds.
C. On April 8, 2013, at around 23:17, the Defendant was subject to regulation on the ground that he driven a Fbenz car while under the influence of alcohol to the security guards of the G police box called out after receiving a report at the first floor parking settlement office of the building E in Sung-nam-si, Sungnam-si.
The Defendant, who was demanded by the above H to present his driver’s license, stated that he would drive a driver’s license, and that he would do so. He expressed that he would do so, and assault H, such as “this sponse flick flick flick flick flick flick flick flick flick flick flick flick flick flick flick.”
Accordingly, the defendant interfered with legitimate execution of duties by police officers on traffic control.
2. Defendant B is on the third floor of the building E in Seongbuk-gu, Sungnam-si.
