1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. The Plaintiff, a foreigner of Mongolian nationality, entered the Republic of Korea on September 9, 2017, with the status of stay C-3 (short-term visit).

B. On November 24, 2017, the Plaintiff filed an application for recognition of refugee status with the Defendant, but on March 14, 2019, the Defendant rendered a disposition to recognize refugee status (hereinafter “instant disposition”) on the ground that it is difficult for the Plaintiff to recognize “the well-founded fear of persecution” as stipulated in Article 1 of the Convention on the Status of Refugees (hereinafter “Refugee Convention”) and Article 1 of the Protocol on the Status of Refugees (hereinafter “Refugee Protocol”) and Article 1 of the Protocol on the Status of Refugees.

C. On June 4, 2019, the Plaintiff appealed to the instant disposition and filed the instant lawsuit.

2. The assertion and judgment

가. 원고의 주장 원고의 전 남편과 시댁 식구들은 모두 무슬림이었는데, 1997년경 원고의 전 남편이 사망하자 시댁 식구들이 전 남편의 형과 결혼할 것을 강요하였고, 이에 응하지 않는 원고에게 위협을 가하였다.

The plaintiff was even subject to sexual indecent acts and assault against the former husband's punishment.

After that, upon the death of the former husband's punishment, the former husband forced the former husband to marry with the former husband and has exercised violence.

원고가 본국인 몽골로 돌아갈 경우 여전히 시댁 식구들로부터 결혼을 강요당하면서 생명 또는 신체적 자유에 대한 위협을 받을 우려가 있다.

Nevertheless, the disposition of this case which rejected the Plaintiff’s application for refugee status should be revoked as it is unlawful.

B. Article 2 Subparag. 1 of the Refugee Act provides that a person who is a refugee is a race, religion, nationality, and specific person.
