Reasons
1. Basic facts
A. The Plaintiff’s claim against C is 1) The land credit union (hereinafter “the land credit union”)
(1) The loan 15,00,000 Won and the interest interest corresponding thereto (hereinafter “the claim in this case”) shall be extended to C.
(2) On April 26, 2004, C filed a lawsuit for a loan claim with the Daegu District Court Decision 2004Ga78050 to preserve the claim against C, and the Korea Deposit Insurance Corporation paid KRW 15,000,000 to the Korea Deposit Insurance Corporation and the delay damages therefor.
3) The Korea Deposit Insurance Corporation transferred the instant claim to the Plaintiff according to the asset transfer contract, and the Plaintiff was granted an execution clause for succession to the said final judgment, and such succession was served to C on March 15, 2007. (B) Compulsory auction C on the real estate owned by C was served to C on March 15, 2007. The compulsory auction C on the real estate owned by C is called the instant real estate “instant real estate”).
A) The real estate was owned by the Plaintiff, but at the Plaintiff’s request for compulsory auction, B to the Daegu District Court for the real estate of this case (hereinafter “instant auction procedure”).
