A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 2014, the Defendant: (a) obtained a driver’s license for a victim issued by the Commissioner of the Gyeonggi Provincial Police Agency, who lost the victim E, and (b) did not take necessary procedures, such as returning the driver’s license for the victim issued by the Commissioner of the Gyeonggi Provincial Police Agency; (c) obtained the driver’s license for the victim’s vehicle from the third Deputy Police Officers located in the Da gas charging station in Yongsan-gu, Busan.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. At around 23:45 on December 16, 2014, the Defendant driven a fyst or other car under the influence of alcohol concentration of about 1km from the 9th military police police unit located in Soyang-gu, Soyang-gu, Yangyang-si, Seoyang-si, to December 16, 2014, around 23:57, the Defendant driven a fyst or other car under the influence of alcohol concentration of about 0.091% without a vehicle driver’s license.

3. On December 16, 2014, the Defendant on the unlawful uttering of official document presented his/her driver’s license to E issued in the name of the Commissioner of the Gyeonggi Provincial Police Agency as if he/she was his/her driver’s license for himself/herself, and presented it to the public document that he/she was requested to present his/her driver’s license as a result of driving without a license or driving under paragraph (2).

4. On December 16, 2014, around 00:00 and around 00:03, the Defendant: (a) controlled and measured by drinking and without a license on the roads front of the nine-year military police branch of Seongdong-gu, Seoyang-gu; and (b) measured by 0.091% of blood alcohol concentration; (c) the Defendant presented E’s driver’s license obtained as stated in paragraph (1) with criminal punishment, and made the completion of his/her work as if he/she were E; (d) written his/her name on the front of the nine-year military police branch of Goyang-gu, Seoyang-gu; and (e) written his/her own signature and seal on the front of the nine-year military police branch of Goyang-gu; and (e) written on the front of the nine-year military police branch
