투자금으로 200만원을 주면 굼벵이 사업에 투자 하여 12주 동안 매주 투자금액의 10%를 주겠다 ”라고 거짓말을 하였다.

그러나 사실 피고인은 본건 이전에 진행한 사업이 부도가 난 상황이었고, 굼벵이 사업을 해 본 경험이 없었으며, 굼벵이를 납품할 제약회사 및 수입업체 등 거래처가 확보되지 않았고, 본건 당시 별다른 재산이 없었고 신용 불량자로서 은행에 대한 채무 9억원 및 다른 투자자들에 대한 채무 1억 8,000만원이 있었으며, 피해 자로부터 돈을 받아 다른 투자자들에 대한 수익금 변제 등으로 사용할 생각이었으므로 피해 자로부터 돈을 받더라도 매주 투자금의 10%를 수익금으로 지급해 줄 의사나 능력이 없었다.
