피고인은 2011. 1. 14. 10:00경부터 같은 달 21. 22:00경 사이에 파주시 B 2층에 있는 피해자 C이 운영하는 'D' PC방 내에서 사실은 사용료 등을 지불할 의사나 능력이 없음에도 불구하고 마치 그 대금을 지불할 것처럼 피해자를 기망하여 이에 속은 피해자로부터 PC 사용료 180,400원, 라면 5개, 음료수 1개, 과자(짱구, 자갈치, 마늘바게트), 옥수수 수염차 등 15,600원 도합 196,000원 상당을 제공받고 이를 지불하지 않는 방법으로 동액 상당의 재산상 이득을 취득하였다.
