A defendant shall be punished by imprisonment for a year and a fine of 34,200,000 won.
When the defendant does not pay the above fine.
Reasons
Punishment of the crime
The defendant is the representative of the "D" located in Daegu Northern-gu C, and is the resident of the Republic of Korea who has the domicile of 201 Dong-dong 602, Daegu-gu apartment complex E.
1. When it is intended to export, import or return goods in violation of the Customs Duties by smuggling, the name, standard, quantity and price of the relevant goods and other matters prescribed by Presidential Decree shall be reported to the head of a customhouse;
Nevertheless, on June 19, 2012, the Defendant imported 45,648m from the Daegu Customs Office of Daegu, China, and reported that he imported 43,050m from the Central Republic of Korea, and imported 2,59,411m of the Central Republic of Korea from the cost of KRW 2,299,411 without reporting to the customs collector.
In addition, from that time until June 2, 2016, the Defendant imported a total of 53 times through Daegu customs office, such as the list of crimes (1) in the attached Table 5,33,548m, the Defendant reported that he/she imported 4,131,479m of the Republic of Korea raw materials of China, and imported 1,202,069m of the cost of KRW 569,93,715, without filing a report thereon with the customs office.
2. Where he/she intends to export, import or return goods in violation of the Customs Duties Act due to the evasion of customs duties, he/she shall file a false report thereon with the head of a customs office on the name, size, quantity and price of the relevant goods, and other matters prescribed by Presidential Decree and shall not import the relevant goods without filing a false report
Nevertheless, on January 3, 2012, the Defendant, while importing the Central Republic of Korea from Daegu Customs Office, evaded KRW 1,064,076 in the amount of customs duties imposed on KRW 61,184,929 ($ 52,239) ($ 47,883,043 ($ 40,882) ($ 40,882) equivalent to USD 13,300,949 ($ 11,356).
In addition, from that time until June 2, 2016, the Defendant added up the difference over 64 times through Daegu Customs Office, such as the list of crimes (2) in attached Table 2, from that time until June 2, 2016.
