1. Basic facts

가. 피고는 원고를 상대로 이 법원 2016가단202390호로 건물 철거 소송을 제기하였는데, 이 법원은 2016. 4. 28. 1. ‘피고(이 사건 원고를 칭한다)는 원고(이 사건 피고를 칭한다)에게, 별지 목록 기재 및 도면 표시 ㉯, ㉰, ㉱, ㉲, ㉳, ㉴, ㉵, ㉶부분 지상 각 건축물을 철거하고, 위 ㉯, ㉰, ㉱, ㉲, ㉳, ㉴, ㉵, ㉶부분 토지 및 ㉷, ㉸부분 각 마당, ㉹부분 통로를 각 인도하고, 2016. 3. 12.부터 위 가.항 기재 각 건축물의 철거 및 각 토지 인도 완료일까지 월 400,000원의 비율로 계산한 돈을 지급하며, 소송비용은 피고가 부담한다’는 취지로 선고하였고, 그 판결을 그 무렵은 확정되었다

The Defendant filed an application with the competent court for the confirmation of litigation costs under the instant final judgment, which determined on June 28, 2016 that “the Defendant (referring to the Plaintiff in this case) is KRW 1,114,769, the amount of litigation costs to be reimbursed by the Plaintiff (referring to the Plaintiff in this case) according to the said judgment.”

C. On April 7, 2016, the Plaintiff removed and handed over the said building to the Defendant. On July 8, 2016, the Plaintiff remitted each of the instant litigation costs KRW 1,147,769, and KRW 348,390 based on the final judgment of the instant case on August 26, 2016 (=27 days from March 12, 2016 to April 7, 2016 x KRW 400,000 per month).

According to the above facts finding as to the cause of the claim, on April 7, 2016, the Plaintiff performed the obligation to remove the building and deliver real estate to the Defendant according to the instant final judgment, and paid the rent and the final amount of litigation costs based on the instant final judgment. Thus, the Plaintiff’s claim against the Defendant for removal of the building, etc. in this court and this court.
