A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

The defendant of "2015 Highest 5168" is a person who operates a travel agency business with the trade name of "D" on the five floors of the Busan-gu C building in Busan-gu.

1. The Defendant’s fraud against 20 victims E, etc. on or around September 3, 2014 to 20 persons, such as victims E, etc., who are members of F Mountain Association, at the above “D” office, and “from July 31, 2015 to 20 persons, such as victims E, etc.

8. From 13th century to 14th day, 13th day of 14th century, it was false that 4.640,000 won per person, who paid 1 French MMB and Mana M TM course, will be accompanied to and take out trekking travel.

However, even if the victims receive travel expenses, there was no intention or ability to arrange trekking travel.

As such, the Defendant: (a) by deceiving victims; (b) transferred money to G from G to the Chairperson of the Mountain Association as stated in the attached Table of Crimes (i); (c) obtained KRW 20,000,000 from H to the Busan Bank Account (I); and (d) obtained KRW 25,00,000 from January 16, 2015 to the Busan Bank Account on February 26, 2015; and (c) obtained KRW 2,00,000,000 from the Busan Bank Account on March 31, 2015 to the Busan Bank Account (J) with KRW 2,00,000,000, KRW 5,000,000 from the Busan Bank Account under the name of H on July 8, 2015; and (c) obtained the said KRW 205,035,010 to the Agricultural Bank Account on July 205, 2015.

2. On February 12, 2015, the Defendant for fraud against 11 victims L, etc.: “from January 18, 2016 to 11 victims, etc., who are members of a mountain conference at the aforementioned place.”

However, even if the victims receive travel expenses, there was no intention or ability to arrange overseas trekking travel.

As such, the Defendant: (a) by deceiving victims; (b) had them transfer money from G to the chairperson of the Mountain Association, such as written in the List of Crimes in the attached Table; and (c) on March 24, 2015, the Defendant sent money from G to the Busan Bank Account (J) 3,000,000 won; and (d) March 26, 2015.
