Facts of recognition

On September 2006, the new Korea Mutual Savings Bank Co., Ltd. (hereinafter the new Korea Mutual Savings Bank Co., Ltd. was changed to the new Savings Bank) with respect to the Plaintiff B extended a loan of KRW 2.14 billion to C at the rate of interest rate of KRW 3.6% per annum, and on September 28, 2010, the due date for payment was determined as KRW 3.6% per annum, and the said loan was jointly and severally guaranteed by Section C.

The New Savings Bank, Inc., transferred the above loan claims against the Maritime Partners Co., Ltd. and SSS., and the Maritime Partners Co., Ltd. and CSSS. re-transfer the above claims to the Kao Assets Management Loan Co., Ltd., on July 27, 2011, the Kao Assets Management Loan Co., Ltd. transferred the above claims to the Plaintiff and notified C of the above assignment on September 14, 201. The above notification was delivered to C on September 19, 201, and the liabilities calculated as of September 14, 2011 were the sum of the principal and interest.

The Plaintiff filed an application with the Seoul Western District Court for a payment order against the principal debtor C and the joint surety B as of September 22, 201 to jointly and severally pay the total amount of KRW 731,408,448 as of September 22, 201 and the annual damages for delay of KRW 18% as of the principal amount of KRW 307,02,884 as of September 22, 201. After the payment order was delivered to both C and B, the said payment order was delivered to C and B on October 15, 201, and each of the above payment orders was finalized as of November 22, 201.
