2. 정보통신망이용촉진및정보보호등에관한법률위반(명예훼손) 피고인은 2020. 1. 13. 제1항 기재 장소에서 ‘E’이라는 페이스북 계정을 생성하고, 피해자 F(가명, 13세)의 성착취 동영상의 얼굴 사진과 출신 학교를 프로필 사진으로 등록한 후, 이를 보고 페이스북 메신져로 연락한 피해자의 친구인 G에게 “얘 누군지 알고 싶어서 찾아본건데, 너 혹시 얘랑 친하냐, 얘 ㅈㄴ(좆나) 유명한 걸레여서 ㅋㅋㅋㅋ, 어떤앤지 궁금했음, 얘 다른 사진 보여줌 ㅋㅋㅋㅋ, 얼굴말고 야한거도 있ㅇㅇ, ㄱㄹ(걸레)인건 맞으니까 함 대달라해보셈. 전번 알려줘바 내가 꼬셔보게, 왜 걸레인지 알려줌 ㅇㄷ(야동)싸이트에 올리던애임”이라는 내용의 메시지, 피해자의 얼굴 사진을 전송하였다.

Accordingly, with the aim of slandering the victim, the Defendant undermined the honor of the victim by disclosing publicly false facts as if the victim was a female student sexually disturbed through the information and communications network.
