A has established a number of companies including family members, employees, etc. from around 2010 to 1,00 in the name of each company, and registered items with bidding price of up to 3 to 5 members, and combined operation of the above companies. The defendant B is a person who has been in charge of the above company's practice in accordance with the direction of defendant A while the director in charge of the management of the merger plan is in office.

1. 그럼에도 피고인 A는 N 일자 경 조달청 전자조달시스템에 입찰 공고된 O 지방 조달청 발주의 의무 물자 지혈대 등 2 항목 구매 의뢰( 수요기관 P) 건 입찰에 참여함에 있어 ㈜Q, ㈜R, ㈜S, ㈜T, U, V, W, X 명의로 입찰하면서 각 업체 투찰 담당자들 로 하여금 자신이 지지하는 가격대로 투찰할 것을 지시하고, 피고인 B은 그 지시에 따라 투찰함으로써 의무 물자 지혈대 등을 73,859,700원에 낙찰 받은 것을 비롯하여 2012. 7. 2. 경부터 2017. 2. 22. 경까지 별지 범죄 일람표 기재와 같이 같은 입찰 공고 건에 사실상 1개의 업체임에도 다수 업체 명의로 여러 개의 가격으로 투찰하는 방법으로 가격을 담합하여 위 각 업체들 명의로 342회에 걸쳐 합계 15,444,794,000원을 낙찰 받았다.
