A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

Around March 13, 2012, the Defendant issued KRW 40 million to the victim E (hereinafter “instant pine”) in the D’s office located in Pyeongtaek-si, Pyeongtaek-si, and received KRW 80 million in total by transferring KRW 40 million to the Defendant’s post office account (Account Number: H) in the Defendant’s name (Account Number) and KRW 40 million in the Defendant’s name (Account Number) account in the Defendant’s name) on the same day.

However, in fact, the owner of the instant pine trees had no authority to dispose of the said pine trees. Although the Defendant entered into a contract with the O around May 31, 2010 to purchase the said pine trees from the O, theO did not acquire ownership of the said pine trees, the Plaintiff entered into a contract to sell the said pine trees worth KRW 113 million with the P around May 2010, which was KRW 12 million and KRW 300,000,000,000,000 for the remainder payment of KRW 12 million,000,000,000,000 for the remainder payment of KRW 1,000,000,000,000,000 for the remainder payment of KRW 1,000,000,000,000,000,000,000,0000,000,000 won for the remainder payment of KRW 2.3 billion.
