Reasons
Punishment of the crime
E was a person in charge of material management, such as paint, at H, which is an internal painting subcontractor of a victim G company (hereinafter referred to as “victim company”) located in F at the macro-si, and Defendant A is a person in charge of material management, such as paint, in the above H, and Defendant B is a person in charge of material management, such as paint, in the victim company’s internal painting subcontractor. Defendant B is a person in charge of material management, such as paint, in the victim company’s internal painting subcontractor, and the J collected and transported the waste generated from the victim company, as an employee of K, a oil hold cleaning company.
J and E, in collusion on June 2018, in order for E to take place a paint used for the victim company’s painting work, the J would sell it and divide the profits therefrom, and Defendant A and Defendant B received a proposal from E to “to help the victim company take out the paint,” and Defendant A and Defendant B attempted to assist in carrying the paint out to the outside, and Defendant B conspired to allow the victim company to take it out.
1. Defendant A
A. Special larceny (1) The Defendant, in collaboration with E, prepared and printed out a non-deposited article out of 42 of the market price of the victim company by linking the victim company’s paint application system with the computers located in H office on October 26, 2018. The Defendant, along with E, took 42 of the victim company’s hull design contractor companies in the victim company into Lpoter vehicles operated by the Defendant, carrying 40 of the victim company’s regular door to the closed warehouse located in M with J, and bringing 40 of the victim company’s price to the waste warehouse located in M with J, which was promised in advance, by means of taking 40 of the victim company’s market price, including cutting 40,000 won, including 40,000 won, from May 30, 2019 to May 30, 2019.
