A defendant shall be punished by imprisonment for one year.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

1. A violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials) on the Possession of Child and Youth obscenity for profit: (a) around July 3, 2018, the Defendant purchased a sexually related video recorded directly through the Internet “D” website, etc. in the Dong-gu Incheon Metropolitan City B apartment C’s residence; and (b) had the intent to sell it to others and make profits therefrom; and (c) from E, the Defendant purchased a video file for sexual intercourse with adults, etc. and kept it in the Internet F.

Accordingly, the Defendant possessed child or juvenile pornography for profit-making purposes.

2. Around July 11, 2018 and July 18, 2018, the Defendant posted a notice to the effect that obscene videos are sold in SNS, such as Internet D website, at the same place as indicated in paragraph (1), and at the same time as indicated in paragraph (1), and at the same time, around July 18, 2018, the Defendant sent a notice to the effect that the Defendant sells obscene videos. A total of KRW 950,000,00 to the G that reported it, and the child and juvenile pornography purchased and held as described in paragraph (1) and H were linked to sexually related videos taken by the victim I (the age 27) with the consent of the victim.

In addition, from April 1, 2018 to August 16, 2018, the Defendant received total of 10,480,000 won from total of 30 persons for profit-making purposes, as indicated in the attached Table 1, as well as the Defendant sold child and juvenile pornography, and sold a photograph taken by obtaining the consent of the victim against his/her will to cause sexual humiliation or shame.
