1. The Plaintiff:
A. Defendant B, (1) out of the D ground buildings in Ansan-gu Manyang-si, Annyang-si, the attached appraisal map No. 60,61, 2.
Reasons
1. The Plaintiff acquired ownership through Defendant C and F, as indicated below, inasmuch as the pertinent land was originally owned by 333 square meters (hereinafter “instant land”).
In other words, on March 10, 2004, the Newan Credit Union (hereinafter “Newan Credit Union”) set up a collateral on the instant land on March 10, 2004, and the Plaintiff acquired the ownership of the instant land at the auction on March 17, 2016, following the application for the Newan Credit Union (hereinafter “Newan Credit Union”).
Of the land of this case, there is a restaurant building on the part (iii) of 89.65 square meters in the ship connecting each point of (iv) section 60, 61, 62, 3, 4, 64, 65, 66, 67, 68, 69, 70, 71, 25, 26, 27, 28, 29, and 60 square meters in sequence, among the land of this case, the land of this case has a boiler room on the part (iv) of 81, 82, 83, 84, and 81 square meters in sequence with the land of this case, and the building of this case is unregistered, and the building of this case is unregistered.
The instant building was originally owned by H, and thereafter Defendant B acquired the instant building on January 13, 2016 through Defendant C and F, as indicated below.
However, Defendant C, F, and Defendant B did not complete the registration of ownership transfer because the instant building was unregistered buildings.
Of the instant land, the attached appraisal is used as a restaurant site for a part (i) part (ii) of 272 square meters connected each point of 1,2, 3, 4, 5, 6, 7, 8, 40, 41, 42, 21, 22, 23, 24, 25, 26, 27, 28, 29, and 11, 12, 13, 14, 15, 16, 17, 18, 19, 40, 40, 23, 24, 25, 26, 27, 27, 28, 29, and 272 square meters in sequence, which are attached to the instant land.
[hereinafter] The above (hereinafter referred to as "the site of this case" in common name). Defendant C occupies the building of this case and the site of the restaurant of this case while operating a restaurant in the building of this case.
