A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant committed each of the following crimes under the condition that the Defendant had a weak ability to discern things or make decisions due to mental disorders of class 3:

1. 피해자 C에 대한 범행 피고인은 2017. 3. 23. 23:47 경 평택시 D에 있는 피해자 C의 단독주택 앞에서, 아무런 이유 없이 그곳에 놓여 있던 위험한 물건인 대형 망치( 총 길이 85cm, 쇠뭉치 부분 가로 17cm, 세로 5cm )를 들고 피해자 소유인 시가 100,000원 상당의 유리창을 내리쳐 깼다.

2. 피해자 E에 대한 범행 피고인은 2017. 3. 23. 경 평택시 F에 있는 피해자 E 운영의 G에서, 제 1 항 기재 범행에 이어 계속하여 아무런 이유 없이 위 대형 망치로 피해자 소유인 시가 합계 450,000원 상당의 출입문과 출입문 유리를 내리쳐 깼다.

3. 피해자 H에 대한 범행 피고인은 2017. 3. 23. 경 평택시 I에 있는 피해자 H 운영의 J 교회 및 K 교회 나눔의 집에서, 제 2 항 기재 범행에 이어 계속하여 아무런 이유 없이 위 대형 망치로 시가 합계 2,000,000원 상당의 유리창과 유리 출입문을 깼다.

1. Relevant Article 369 of the Criminal Act and Articles 369 (1) and 366 of the Criminal Act, and the choice of imprisonment for the crime;

1. Reduction of mental and physical drugs by law: Articles 10 (2) and 55 (1) 3 of the Criminal Act;

1. The former part of Article 37 of the Criminal Act, and Articles 38 (1) 2 and 50 of the same Act, which aggravated concurrent crimes;

1. However, in light of the reasons, means, frequency, etc. of sentencing under Article 62(1)(the following favorable circumstances) of the Criminal Act, the liability for the crime is not minor, but the error is recognized.
