A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. 도로교통법위반(음주측정거부) 피고인은 2020. 8. 16. 18:05경 경북 울진군 B에 있는 C 장례식장 앞 도로부터 같은 군 D에 있는 도로까지 약 4km 구간에서 E 싼타페 승용차를 운전하던 중, 위 D 앞 도로에서 경북울진경찰서 F 소속 경위 G, H 등으로부터 피고인이 음주운전을 하는 것으로 보인다는 목격자의 신고가 있었고 피고인에게서 술 냄새가 많이 나며 언행도 정상적이지 않고 보행이 많이 비틀거리며 음주감지기 검사에서도 음주반응이 감지되는 등 술에 취한 상태에서 운전하였다고 할 만한 상당한 이유가 있음을 이유로 같은 날 18:22경, 18:27경 음주측정기에 의한 음주측정을 요구받았으나 부는 시늉만 하였고, 같은 날 18:32경 재차 음주측정을 요구받았음에도 “벌금 최대로 먹여라. 어느 놈이 신고 했노. 마음대로 해라.”라고 말하면서 정당한 사유 없이 경찰공무원의 음주측정요구에 응하지 아니하였다.
