Reasons
1. The summary of the facts charged is that the Defendant is a person who operates an agency for collecting and transporting food waste in the name of “(D) E” in Chungcheongnam-si, and F is a person who operates a waste disposal agency in the name of “(D) G” in the same office as “(D) E” in the Defendant’s Schedule.
On October 27, 2011, the Defendant concluded a contract on vicarious execution of the collection and transportation of household food wastes with the collection of food wastes from November 1, 2011 to December 31, 2012, the Defendant collected and transported food wastes (hereinafter referred to as “waste for home use”) discharged from a general home house and a small restaurant in the Chungcheong-si Zone 1 (H, I, and J, etc.) (hereinafter referred to as “waste for home use”) to “(ju) G” and the Defendant paid 54,370 won per ton from the Chungcheong-si to December 31, 2012.
F From January 1, 201 to December 31, 2012, F entered into an agreement with the victim on the disposal of household wastes collected and transported by the Defendant, and then to be paid KRW 104,000 per ton from the Chungcheong City.
【Criminal Facts】
A. On January 2012, from around December 2012 to around December 2012, the defrauded, whose beneficiary is the Defendant, collected and transported garbage in the first region of Chungcheongnam-si, and even though it is required to collect and transport only household garbage, such as the terms and conditions of the above contract, the Defendant collected and transported food garbage (hereinafter referred to as “brupt garbage in a large quantity of business that discharges large amounts of food waste (such as a collective meal service establishment with at least 10 persons per day average of at least 10 square meters per day or a restaurant with a total of at least 200 square meters per day) by mixing it with household garbage.
1. On February 8, 2012, the Defendant claimed an agency fee for collecting and transporting food waste on January 2, 2012, including large-scale waste 42.272 tons of business sites discharging large quantities, which were collected and transported by mixing as above, from the victim on February 8, 2012.
