Punishment of the crime

1. Defendant A is the representative of the KMM in Busan Metropolitan City MM building N, who operates hotel business with 20 full-time employees.
The defendant shall serve as a member at the place of business from November 13, 2014 to February 28, 2019.
A retired worker P did not pay KRW 5,210,532, such as wages of KRW 1,733,30 in January 2019, and did not pay KRW 10,307,062 in total amount of wages of KRW 10,30 in the attached Table of Crimes (1) Nos. 3 and 4, as stated in the attached Table of Crimes (1).
Defendant B, until February 28, 2019, is the representative of (State) PS in the Qu Building of Busan Metropolitan City, who used 70 full-time workers and operated human resources service business. Defendant A, as the representative of (State)S from March 1, 2019, is the employer who employs 70 full-time workers and operates human resources service business.
2. Defendant B is working as a member from August 1, 2017 to October 31, 2018.
The retirement allowance of T retirement 2,350,682 won (attached Form 5 No. 2) has not been paid within 14 days from the date of retirement without any agreement on the extension of the payment date between the parties concerned.
3. Defendant A did not pay KRW 7,930,69,322 in total amount of money and valuables 59,465,322 won (attached Form 36,811,716 won, attached Form 42,65,606 won, etc.) from September 11, 2017 to April 5, 2019, including the fact that he/she did not pay KRW 7,930,697 in total, including KRW 2,134,233 won, retirement allowance 3,126,975 won, and KRW 7,930,697, as stated in attached Table 3, 5,465,322 won (attached Form 36,81,716 won, and KRW 42,653,666 won) within 14 days from the date of retirement without agreement between the parties concerned on the extension of the payment period.

4. The defendant A employs 70 full time workers as the representative of (ju) from (R) of the Qu Building in Busan Shipping Daegu.
