1. The defendant shall be the plaintiff.

(a) As regards KRW 36,877,120 and KRW 20,000 among them, from October 25, 2012 to KRW 16,87.

1. Facts of recognition;

A. 1) The Plaintiff is the Plaintiff’s 511m2 (hereinafter “instant land”).

2) The instant land (broom-friendly part) is adjacent to the Busan Northern-gu C site, D site, and E site as follows, and is adjacent to the F site, G site, and H site, respectively.

At present, buildings are newly constructed on the F site, D site, C site, G site, H site, and E site.

3) On May 30, 1972, the instant land was designated as a road scheduled site under the Urban Planning Act (Class 14, 8 meters wide, 1,190 meters wide, starting from May 30, 197, by announcement of the Busan Metropolitan City and Metropolitan Cities, as a road site under the Urban Planning Act (section 14, 8 meters wide, 1,190 meters wide, starting point: J) and was used as a road for the general public in non- packing state, and then was packed as a ice concrete (as a result, asphalt concrete). Although the instant land was announced as a road under the Road Act, it was designated as a “third-class general residential area, and road” under the National Land Planning and Utilization Act, and around August 208, 208, the date of installation of urban gas pipelines was the date of installation, and the non-urban gas facilities were installed.

On the other hand, drainage is installed on the ground of the instant land.

B. Division 1 of the instant land and its neighboring land: F.D site, D site, C site, G site, H site, and E site, both of the instant land and its neighboring land, are 2,774 square meters in Busan Northern-gu (hereinafter “Before subdivision”).

2) The Plaintiff, K, and L purchased the land before subdivision and completed the registration of ownership transfer on June 21, 1978. The Plaintiff, K, L, M, N, andO, a co-owner of the said land, filed an application for land division of the said land on November 9, 1981. Accordingly, the said land was divided into FY 1,544 square meters on November 11, 1981, and D 648 square meters (the land category was changed to the site on March 13, 1982) and PP 582 square meters (the land category was changed to the site on January 14, 1988).
