1. Case summary

A. 1) The Plaintiff’s trademark/service mark No. 45-2012-4599 (hereinafter “instant applied trademark/service mark”) on September 7, 2012 is subject to the application number of the Plaintiff.

(2) On April 7, 2014, the Korean Intellectual Property Office examiner rendered a decision of refusal on the ground that the trademark or service mark of this case is similar to the prior registered trademark, the mark, and the designated goods and thus cannot be registered pursuant to Article 7(1)7 of the Trademark Act.

3) On May 8, 2014, the Plaintiff filed an appeal with the Intellectual Property Tribunal seeking revocation of the foregoing decision of refusal (No. 2014 won2771). The Intellectual Property Tribunal rendered a trial ruling dismissing the Plaintiff’s request on September 17, 2015 (hereinafter “instant trial ruling”).
