Punishment of the crime

1. Fraud against the victim B;

A. However, the defendant did not have served as the Director General of the F Arts Bureau, and even if he received money from the victim, he thought that he would use it as operating expenses of the defendant's company, and he did not have the intent or ability to make the victim contribute to the broadcasting program.

Nevertheless, the Defendant, by deceiving the victim, received 4 million won from the victim, under the name of the International Bank Account in the name of the E in charge of the settlement of accounts around September 25, 2019, as the broadcast contribution fee, etc.

B. Around January 4, 2020, the fraud Defendant made a false statement to the victim B, “A party has made a contribution to G video recording broadcasting on or around January 30, 2020. However, if a party’s mother deposits KRW 300,000 won as a congratulatory money, the Defendant would deliver it to the relevant PD as a congratulatory money.”

However, even if the defendant receives money from the victim, he did not have the intent or ability to make the victim contribute to G broadcasting or deliver the money to the person in charge.

Nevertheless, the Defendant, by deceiving the victim as such, received 300,000 won from the victim to the J association account under the name of the Defendant under the name of the victim under the name of the PE mother in the same day.

Accordingly, the Defendant, by deceiving the victim, received a total of KRW 4.3 million from the victim twice.

2. Fraud to K of a victim;

A.
