A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. The Defendant is a person engaging in driving a B-cracked 1.6 DOHC car.

On April 11, 2019, the Defendant was driving the said car without obtaining a driver's license at around 18:20 on April 11, 2019, and came to turn to the left at the Samcheon-do Park at the intersection of each mountain road located at Scheon-si.

At all times, the intersection where signal lights are installed, a red flickering signal was operated on the front side, and the low-speed car driven by the victim D (the victim D(69 years old) enters the intersection. In such a case, the driver has a duty of care to temporarily stop in front of the intersection and drive the vehicle safely by making it possible for the driver to do so.

Nevertheless, the defendant neglected this and did not temporarily stop in front of the intersection and did not look at the right and the right and the right and the left turn by entering the intersection, and received the front portion of the passenger car of the victim who entered the intersection and opened for the left turn.

The Defendant, by such occupational negligence, escaped from the site without taking necessary measures despite destroying and damaging the said low-priced car to cover KRW 2,356,088 of the repair cost.

2. Around 18:20 on April 11, 2019, the Defendant driven the said car without obtaining a driver’s license from the front of the G organization located in the F of Sacheon-si to the front of each mountain street located in the same city at the same time.

3. No motor vehicle which is not covered by mandatory insurance in violation of the Guarantee of Automobile Accident Compensation Act shall be operated on a road;

Nevertheless, on April 11, 2019, the defendant is in the same time-dong from the roads of G organizations located in Scheon-si F around 18:20.
