Defendant

A and B shall be punished by imprisonment for 6 months, by a fine of 300,000 won, and by imprisonment for 4 months, respectively.

Punishment of the crime

1. 피고인 A, B의 폭력행위등처벌에관한법률위반(공동상해), 특수상해 피고인 A은 2019. 11. 02. 23:10경 부산 동구 E에 있는 ‘F’에서 평소 알고 지내던 피해자 C(40세)이 인사를 하지 않고 기분 나쁘게 쳐다 본다는 이유로, “마, 개자슥아, 좇 같나”라고 욕설을 하며 오른손으로 피해자의 뺨을 1회 때린 후 위 주점에 있던 위험한 물건인 맥주병으로 피해자의 머리를 때리고, 피고인 B은 피해자가 위와 같이 구타를 당하면서 저항한다는 이유로, 위 주점에 있던 위험한 물건인 맥주병을 집어 들어 피해자를 향해 던졌다.

이로써 피고인들은 공동하여 피해자에게 약 3주간의 치료를 요하는 두피의 표재성 손상, 타박상, 목삠(염좌), 상세 불명의 어깨 및 위팔의 표재성 손상, 이마의 표재성 손상, 박리, 찰과상 등을 가함과 동시에 위험한 물건을 휴대하여 위와 같은 상해를 가하였다.
